These Terms of Service ("Terms") govern your access to and use of Mindphor Intelligence (the "Service"), operated by Santhosh Kumar ("we," "us," or "the Operator"), currently operating as an individual/sole proprietor based in India. By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. What Mindphor Intelligence Does
Mindphor Intelligence is a SaaS platform that monitors publicly available app store reviews (currently Google Play Store and Apple App Store, covering all countries/storefronts) and publicly available competitor changelogs, and uses AI to generate sentiment analysis, summaries, and actionable insights for indie founders and small SaaS teams.
2. Eligibility and Accounts
- You must be at least 18 years old to use the Service.
- You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
- You may sign in via email/password, GitHub, or Google. You are responsible for the accuracy of any information you provide.
3. Subscriptions and Billing
- Paid plans are billed through Paddle.com, our payment provider and Merchant of Record. Paddle handles all payment processing, card data, invoicing, tax collection/remittance, and refund/chargeback administration on our behalf. We do not collect or store your payment card details.
- Your purchase is subject to Paddle's own terms and privacy policy, in addition to these Terms.
- Subscription fees are billed on a recurring basis (monthly, as displayed at checkout) until cancelled. You may cancel at any time; cancellation takes effect at the end of the current billing period unless stated otherwise.
- Refunds, where applicable, are handled by Paddle in accordance with their refund policy.
4. Data Sources and Third-Party Content
- The Service ingests publicly available data (e.g., app store reviews, public changelogs). We use automated tools to collect this publicly available data. We do not use adversarial scraping techniques to bypass a platform's access controls or terms of service, and some data sources may be unavailable at any given time due to third-party restrictions.
- We do not guarantee the completeness, accuracy, or continued availability of any third-party data source.
5. AI-Generated Content
- The Service uses AI models (including but not limited to Google Gemini) to generate sentiment classifications, summaries, and insights.
- AI-generated output may contain inaccuracies. You should independently verify any insight before relying on it for business decisions.
6. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose.
- Attempt to reverse-engineer, scrape, or interfere with the Service's infrastructure.
- Share your account credentials with unauthorized third parties.
- Use the Service to harass, defame, or infringe on the rights of others.
7. Intellectual Property
- We retain all rights to the Service's software, design, and branding.
- You retain ownership of any data you input into the Service (e.g., your app/competitor configurations). You grant us a limited license to process that data solely to provide the Service.
8. Termination
We may suspend or terminate your access to the Service if you violate these Terms. You may stop using the Service and cancel your subscription at any time.
9. Disclaimers
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT AI-GENERATED INSIGHTS WILL BE ACCURATE.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE OPERATOR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.
11. Changes to These Terms
We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms. Material changes will be notified via email or in-app notice where feasible.
12. Governing Law
These Terms are governed by the laws of India, without regard to conflict-of-law principles. Any disputes shall be subject to the exclusive jurisdiction of the courts of India.
